Terms of Service
These Terms of Service ("Terms") govern your use of the GymHub mobile application ("App") operated by GymHub ("we", "us", or "our"). By using the App, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using the App, you confirm that you are at least 13 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. Description of Service
GymHub is a fitness and nutrition tracking application that allows you to log workouts, track meals, sync with Apple Health, and view progress charts and insights. The App is provided for personal, non-commercial use.
3. Account Registration
You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at contact@moonlightapps.dev if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Upload harmful, offensive, or infringing content
- Reverse engineer, decompile, or disassemble the App
- Use the App to provide medical advice to others
- Interfere with or disrupt the App's operation
5. Health and Medical Disclaimer
GymHub is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is intended for general fitness and wellness tracking only. Always consult a qualified healthcare professional before starting any exercise or nutrition program, especially if you have a medical condition. Use of the App is at your own risk.
6. Apple Health Integration
If you connect the App to Apple Health, you authorize us to read and write fitness data as described in our Privacy Policy. You can revoke this permission at any time through your device settings.
7. Intellectual Property
The App, including its design, code, logos, and content, is owned by GymHub and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
8. User Content
You retain ownership of content you upload (e.g., meal photos, workout logs). By uploading content, you grant us a limited license to store and display it solely to provide the App's features to you.
9. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms or for any other reason at our discretion. You may delete your account at any time through the App or by contacting us. Upon termination, your right to use the App ceases immediately.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the maximum extent permitted by law, GymHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or health-related outcomes, arising from your use of the App. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by updating the effective date above or through the App. Continued use after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Romania, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Romania.
